New COVID-19 law

What does it mean for you and for the cultural industry?

On 25 September 2020, the new COVID law was adopted in parliament and came into force on 26 September 2020. In article 11 of this law, the measures in the cultural sector are explained. The most important facts are explained here:

For musicians

Corona compensation (EO)

Der Anspruch gilt ab dem 17. September 2020 und endet am 30. Juni 2021 (nicht 31. Dezember 2021). Nach diesem Datum können keine Ansprüche mehr geltend gemacht werden.

The entitlement is valid from 17 September 2020 and ends on 30 June 2021 (not 31 December 2021). No claims can be made after this date.

Self-employed persons are entitled, if…

… an event had to be cancelled or could not take place

… there is a loss of earnings.

❗Requirement: An authority has not approved, cancelled or prohibited the event.

👀 The compensation will be paid only for the day of the event and the preparation time

Concerning loss of earnings: Only those with a loss of earnings or salary of at least 55% in comparison to the average revenue of the years 2015-2019 are eligible. Among the entitled persons are in particular also self-employed persons.

DEADLINE: 30. Juni 2021

Emergency Aid

As the conditions are still unclear, new applications may be submitted, but they will not be considered before 15 October 2020 at the earliest.

For cultural enterprises

It is regulated by Articles 11 and 12 of the COVID-19 Act. The Federal Office of Culture (FOC) may conclude service agreements with one or more cantons. The contributions are paid to cultural enterprises upon request as compensation for loss of earnings and for transformation projects.

Cultural associations in the layman’s area receive on request from the umbrella organizations compensation for the financial loss associated with the reduced holding of events. A maximum of 10’000 CHF per cultural association.

Hardship measures: A case of hardship exists if the annual turnover is below 60% of the multi-year average. Possible measures include loans and Á-Fonds-Perdú amounts

Ad-hoc event contributions due to COVID-19 pandemic: Until the end of 2020 support for ad-hoc events up to 5000 CHF. Deadline for submission: 15 December 2020. Further information on submitting applications here

What we recommend

For musicians as well as for cultural enterprises we recommend to wait and see. Detailed information for all areas and the various support measures as well as the new application forms will probably not be available until the end of October.
